Terms and Conditions.

The following provisions amend the statutory provisions of §§ 651a-m BGB (German Civil Code) and §§ 4-11 of the “Verordnung über Informations-und Nachweispflichten nach bürgerlichem Recht” as implemented by German civil law due to Directive 90/314/EEC on Package Travel and Holiday Tours. They are based on the recommendations of the DRV (Deutscher ReiseVerband) and are an integral part of the travel contract concluded between the customer and Ameropa Reisen.

1. Conclusion of Contracts/Customer´s Obligations
1.1 Your booking shall be deemed as a firm tender for the conclusion of contract. Any industrial resale of tours or its parts (such as tickets) is prohibited. The basis of your offer is what we advertise including any supplementary information for the relevant journey.
1.2 Agents (e.g. travel agencies) and service providers (e.g. hotels, carriers) are not authorized to modify travel contracts or exceed Ameropa´s contractual obligations by agreement or any kind of assurance. The same is true for providing any kind of information that is contrary to what we advertise.
1.3 The following applies to all booking channels:
a) The basis of the offer is what we advertise including any supplementary information for the relevant journey.
b) In case of explicit and separate declaration of commitment you will be obliged to perform your contractual duties as well as fellow passenger´s duties.
c) Variations from Ameropa´s acceptance and booking will be deemed to be a new offer which will be binding for a period of ten (10) days. The contract will be concluded based on that new offer unless specified otherwise. Any kind of unreserved payment or prepayment will be considered as acceptance.
1.4 The following applies to all bookings by word of mouth, in written form, via telephone, telefax message or by e-mail:
a) Your booking shall be deemed as a firm tender for the conclusion of contract.
b) The contract will be concluded with the receipt of Ameropa´s acceptance which does not require a special form. Ameropa will forward a booking confirmation at the time of or immediately upon conclusion of contract. This does not apply to bookings made less than seven (7) business days prior to the day of departure.
1.5 The following applies to e-commerce bookings (e.g. via Internet):
a) The website explains in compact form the online booking procedure.
b) For correction of input, deleting of data or resetting the whole booking form, Ameropa Reisen provides a way to make corrections. The website explains the procedure.
c) The website indicates the treaty languages.
d) The customer will be informed in case Ameropa Reisen saves the text of the contract. The same applies to the possibility of accessing the text of contract.
e) By clicking the button “zahlungspflichtig buchen” the customer expresses a legally binding proposal towards Ameropa Reisen for the conclusion of a travel contract.
f) Ameropa Reisen will confirm the receipt of your reservation (travel registration) by electronic means without delay.
g) Clicking the “zahlungspflichtig buchen” button does not give a rise to a duty to conclude a travel contract. The travel contract takes effect upon confirmation of the reservation by Ameropa Reisen to the customer. The confirmation is not required to have a special form and might be executed via telephone, e-mail, telefax message or in written form.
h) In case Ameropa Reisen confirms the reservation right after hitting the “zahlungspflichtig buchen” button via screenshot, there will be no interim announcement about receipt of the reservation by Ameropa Reisen. The travel contract is concluded by displaying the confirmation on your screen instead. In any event, the customer will have the opportunity to save and print the booking confirmation. It makes no difference for the legal validity of the travel contract if the customer chooses not to save or print the booking confirmation.
1.6 Ameropa Reisen would like to point out that group bookings of ten ore more related to holiday flats and/or hotels will only be accepted after consultation with Ameropa Reisen.

2. Payment
2.1 Ameropa-Reisen and its agents accept payments prior to the end of your journey only in the event of the delivery of the security note (“Sicherungsschein”). After conclusion of the contract a down payment of 20% of the travel fee is due against the surrender of the security note (“Sicherungsschein”). The remainder of the travel fee is due and payable at the time the customer collects the travel documents (about eight (8) days prior to departure) if the security note (“Sicherungsschein”) has been handed over and if it is certain, the journey cannot be cancelled any more for any reason stipulated in section 13. This applies to all cases of cash payment. In any case of payment by MasterCard or VISA the credit card needs to be presented at the time of booking while the credit card receipt needs to be signed. Please keep in mind that the payment process must be instigated about 28 days prior to departure. The travel documents will be available about eight (8) days prior to departure.
2.2 If any payment (prepayment and final payment) is not remitted or is delayed (default of payment), despite having issued a reminder, then Ameropa shall be entitled to cancel the contract and to claim damages pursuant to the cancellation policy relating to the booking as set out in subparagraphs 10.2 to 10.5.

3. Services
3.1 Basis of the contract is the travel offer as set out in the relevant media. We reserve the right to modify catalogue information prior to the conclusion of contract. Ameropa Reisen is obliged to inform about these modifications prior to booking.
3.2 Ameropa Reisen will not accept any liability for any kind of information, such as hotel leaflets or internet promotion, not provided for by Ameropa Reisen unless otherwise expressly agreed.
3.3 For all bookings including half board, full board or all-inclusive the boarding service will begin with dinner on the day of arrival and will end with breakfast on the day of departure.
3.2 Ameropa Reisen will not accept any liability for any kind of information, such as hotel leaflets or internet promotion, not provided for by Ameropa Reisen unless otherwise expressly agreed.
3.3 For all bookings including half board, full board or all-inclusive the boarding service will begin with dinner on the day of arrival and will end with breakfast on the day of departure.
4. Child Reduction
The child reduction is based on the age of your children on the day of departure and related to the accommodation in an extra bed. The additional costs for childbeds or baby cots have to be paid for on the spot. This applies regardless of any granted child reductions.
5. Extra Bed (additional accommodation)
As far as an “extra bed” is concerned it might well be that your extra bed will be a couch, cot or slumberette placed in your flat or room, etc.. These might be smaller than regular beds. Anyhow you will have to deal with less living space and less space to stow luggage.
6. Basic Information about Holiday Flats and Holiday Homes
Holiday flats and holiday homes have to be occupied with the advertised and confirmed number of guests at the max. Unless otherwise expressly agreed, children shall be deemed as “regular guests” regardless of age (exception: overcrowding is expressly mentioned in the description as far as babies and infants are concerned).
7. Pets
If you want to bring any pets make sure to have the application and permission of the relevant service provider (e.g. renter) to match the requirements. Pets must be applied for at the time of booking. The following details are required for the application: breed, its weight and size. As a general rule fighting dogs are not permitted. Any additional costs must be paid for on site. It shall be understood that pets must not cause annoyance for other guests and are not allowed to be brought to some restaurants, pools or beaches.
8. Ski Pass included
Ameropa Reisen will not allow any reimbursements in the event of failure or limitations of lift operation (weather, maintenance, etc.) as well as the disuse of the ski pass by the customer. We would like to point out that operators reserve the right to open up or close down business without preannouncement later or earlier to the end of the season.
9. Changes in Service and Price
9.1 Ameropa reserves the right to modify services even after the conclusion of contract as long as modifications are necessary, not in bad faith, not considerable and do not change the contract in its entirety.
9.2 Warranty claims remain unaffected in case of modified services being deficient.
9.3 Ameropa Reisen is obliged to inform immediately about considerable modifications in services as soon as Ameropa knows about the reason for changes.
9.4 Ameropa Reisen reserves the right to modify any published and confirmed prices in the event of an increase of costs for transportation or charges levied by government agencies, local authorities, other official authorities or by airport companies, such as harbor fees or airport charges and airport passenger taxes. The same applies for any changes in foreign exchange rates applying to your journey. The aforementioned applies to any cases where the time span between the conclusion of contract and your scheduled day of departure is at least four (4) months. The modification of published and already confirmed prices will be in accordance with the following calculation:
a) in the event of an increase of costs per seat we will charge you with the full increase;
b) in any other case we will charge you with the increase per seat, meaning Ameropa Reisen will divide the full increase by the number of available seats and share the expenses.
9.5 In any case of subsequent price variation Ameropa Reisen is obliged to inform the customer accordingly and without delay. Any price increase as of the 20th day of scheduled departure is void. In any case of considerable changes in service or an increase of more than five (5)% of your total holiday costs you will either be entitled to cancel the contract free of charge or demand to participate in an at least equivalent tour as long as Ameropa Reisen is able to provide an alternative without extra charges.
No matter what option you will be going for, you will be obliged to inform Ameropa Reisen about your decision without delay after being notified about changes/increase.

10. Cancellation prior to departure/Cancellation fees
10.1 You are entitled to cancel your booking prior to departure. The cancellation needs to be forwarded to the given address (see below). In case of booking via one of Ameropa´s agents, Ameropa Reisen accepts the cancellation of contract via the relevant agent. We strongly recommend to cancel in written.
10.2 If you cancel your booking prior to departure or no-show for departure, Ameropa Reisen will lose its claim for the travel price. However, Ameropa-Reisen is entitled to claim adequate compensation for arrangements and expenses already made, depending on the relevant travel price. This applies to cases where the cancellation is not to be traced back to the fact of force majeure or attributable to Ameropa’s fault.
10.3 Ameropa’s claim for compensation is temporally scaled. This means that Ameropa Reisen will calculate its claims in due consideration of the date of cancellation (the receipt of cancellation will be the deciding factor) and your travel price. Furthermore we will take due account, however, of any expenditure which we normally save as a result of any cancellation of the contract or through reallocation.
10.3.1 Standard fees:
A. Hotels, Boardinghouses etc.:
Up to 30 days before departure 20 %,
29-22 days 25 %,
21-15 days 35 %,
14- 7 days 50 %,
6- 2 days 65 %,
1 day or no-show 80 % of the relevant travel price.
B. Holiday Flats and Holiday Homes:
Up to 45 days prior to commencement of the rental time 20 % of the rental instalment,
44-35 days 50 %,
34- 3 days 80 %,
2- 1 days and no-show 90 %.
10.3.2 Exceptions to the standard regulation:
10.3.2.1 “Erlebnisreisen”

2- 1 days and no-show 95 % of the relevant travel price.
C. For the following tours special cancellation fees are valid:

(exception: African Collage Route, Pretoria-Swakopmund and Swakopmund-Pretoria 100 %).
10.3.3 Ameropa Reisen will not accept any exchange or reimbursement of tickets (e.g. sporting event) booked separately from the accommodation but mentioned in the travel confirmation.
10.4 The customer is in any case entitled to provide evidence that Ameropa Reisen has not incurred any or incurred less costs in relation to the withdrawal.
10.5 Ameropa Reisen reserves the right by way of deviation from the above packages, to claim higher, specific damages. In the case Ameropa Reisen exercises its right to claim a higher amount of compensation, it shall, in the interest of saving effort, be obliged to set out details relating to its claim and to provide documentary.
10.6 The traveller´s legal right to place in accordance with § 651 b BGB a substitute participant is not affected by the above conditions.

11. Amendments, Re-Booking, Substitutes
11.1 Any changes in booking are fee required. We will charge you for amendments with 15 € per booking.
11.2 The traveller has no claim for changes as to the date of the trip, the destination, the place of departure, the accommodation and the mode of transportation after conclusion of contract. If the dates, destination, place of departure, accommodation or means of transport are changed on traveller´s request, Ameropa Reisen is entitled to charge re-booking fees as follows, provided the relevant deadlines are met (as far as 10.3.2.1A is concerned, Ameropa Reisen will only carry out re-bookings after withdrawal from the contract and simultaneous new booking):
- 10.3.1 A up to 30 days before departure: 15 € each
- 10.3.1 B up to 45 days prior to commencement of your rental time: 34 € per unit
- 10.3.2.1 A and B up to 60 days before departure: 28 € each
- 10.3.2.1 C1 up to 92 days before departure: 28 € each
- 10.3.2.1 C2 and C3 up to 56 days before departure: 28 € each.
The aforementioned fees apply plus costs for ordered visas and included or additionally ordered tickets. As far as air travels are concerned, Ameropa Reisen will charge an additional fee of 112 € for re-booking after the original tickets have been ticketed. Traveller´s request for re-booking after these deadlines have passed can, if at all possible, be only carried out after withdrawal from the contract according to clause 10.3.1-10.3.3 and simultaneous new booking.
11.3 The traveller is entitled to claim a third party/substitute to adopt the contract. Ameropa Reisen reserves the right to oppose, in case the substitute does not meet the special requirements in relation to the trip. The same applies if the amendment would conflict with statutory provisions or official directives. In any case Ameropa Reisen will charge its additional costs as defined in clause 11.2 (the deadlines in 11.2 shall not be considered). These fees apply plus costs for ordered visas. As far as air travels are concerned, Ameropa Reisen will charge an additional fee of € 112,- for re-booking after the original tickets have been ticketed. In any case, the passenger and the substitute will be held liable as joint and several debtors for both, the travel price and any additional costs.
11.2 The traveller has no claim for changes as to the date of the trip, the destination, the place of departure, the accommodation and the mode of transportation after conclusion of contract. If the dates, destination, place of departure, accommodation or means of transport are changed on traveller´s request, Ameropa Reisen is entitled to charge re-booking fees as follows, provided the relevant deadlines are met (as far as 10.3.2.1A is concerned, Ameropa Reisen will only carry out re-bookings after withdrawal from the contract and simultaneous new booking):
- 10.3.1 A up to 30 days before departure: 15 € each
- 10.3.1 B up to 45 days prior to commencement of your rental time: 34 € per unit
- 10.3.2.1 A and B up to 60 days before departure: 28 € each
- 10.3.2.1 C1 up to 92 days before departure: 28 € each
- 10.3.2.1 C2 and C3 up to 56 days before departure: 28 € each.
The aforementioned fees apply plus costs for ordered visas and included or additionally ordered tickets. As far as air travels are concerned, Ameropa Reisen will charge an additional fee of 112 € for re-booking after the original tickets have been ticketed. Traveller´s request for re-booking after these deadlines have passed can, if at all possible, be only carried out after withdrawal from the contract according to clause 10.3.1-10.3.3 and simultaneous new booking.
11.3 The traveller is entitled to claim a third party/substitute to adopt the contract. Ameropa Reisen reserves the right to oppose, in case the substitute does not meet the special requirements in relation to the trip. The same applies if the amendment would conflict with statutory provisions or official directives. In any case Ameropa Reisen will charge its additional costs as defined in clause 11.2 (the deadlines in 11.2 shall not be considered). These fees apply plus costs for ordered visas. As far as air travels are concerned, Ameropa Reisen will charge an additional fee of € 112,- for re-booking after the original tickets have been ticketed. In any case, the passenger and the substitute will be held liable as joint and several debtors for both, the travel price and any additional costs.
12. Unclaimed Services
Ameropa Reisen will not accept any refund of unclaimed travel services for reasons of premature departure or other reasons, not in the responsibility of Ameropa Reisen. Ameropa Reisen, however, will try to seek reimbursements for the saved expenditures from the relevant service providers. This does not apply if the unclaimed services are insignificant or if reimbursement would conflict with statutory provisions or official directives.
13. Cancellation of Contract due to non-attainment of the minimum number of participants
Ameropa Reisen may, if the published minimum number of participants is not attained, withdraw from the contract in accordance with the following rules:
a) the number of minimum participants as well as the latest date of possible cancellation have to be clearly stated in the relevant travel description and
b) the number of minimum participants as well as the latest date of possible cancellation are clearly stated in the travel confirmation or reference is made to the respective travel description where such information is stated.
A withdrawal by Ameropa Reisen may not be declared later than 28 days before departure. Ameropa Reisen is obliged to notify its customers without undue delay once the condition requiring the cancellation of the contract has arisen. If the trip is not undertaken for this reason, the customer is immediately refunded any payments made on the trip in full.
a) the number of minimum participants as well as the latest date of possible cancellation have to be clearly stated in the relevant travel description and
b) the number of minimum participants as well as the latest date of possible cancellation are clearly stated in the travel confirmation or reference is made to the respective travel description where such information is stated.

14. Termination of Contract for reasons of Conduct
Ameropa Reisen reserves the right to cancel without previous notice (after warning) if traveller´s behavior is such, that other guests feel deeply annoyed or the immediate cancellation of contract is justified by other infringements of contract. Ameropa´s claim for the travel price remains unaffected. We will take due account, however, of any expenditure which will be saved as a result of any cancellation of the contract or through reallocation.
15. Customer´s Obligations
15.1 Notification of Defects
You are entitled to demand remedy in any case of Ameropa Reisen not being able to provide contractual services. However, you are obliged to notify Ameropa Reisen of any defects without delay. If you contravene culpably, Ameropa Reisen will not accept any refund. The aforementioned shall not apply, if the notification appears to have no prospect of success or appears to be unreasonable.
It is your obligation to forward your complaints to Ameropa´s representative on site. In destinations without representatives on site you are obliged to forward your complaints to our service providers (hotel management, renter etc.; you will find the relevant addresses in your travel documents) or directly to Ameropa-Reisen, Bad Homburg. Both our representatives and our service providers are instructed to arrange remedy if possible. Neither our representatives nor our service providers are entitled to accept claims. Ameropa Reisen is obliged to inform about the person, reachability and the communication data of its representative with its travel description and/or travel documents.
15.2 Deadline prior to cancellation
You will be obliged to allow a reasonable period of time for remedy if you want to cancel your contract because of travel defects, as per § 651e BGB. The same is true for any termination for cause.
The aforementioned does not apply if Ameropa Reisen denies remedy or remedy appears to be impossible. The same is true for any termination with immediate effect because of a customer´s special, foreseeable, legitimate interest.
15.3 The loss or delay of baggage
In case of loss, damaged or delayed baggage, Ameropa Reisen would like to recommend its customers to ask the relevant airline (without delay) to issue a Property Irregularity Report (PIR). As a rule, airlines refuse to make reimbursements if a notice of claim (PIR) has not been filled out. The claims for lost luggage is to be made within 7 days for delay within 21 days of delivery. Apart from that, if the baggage is lost, damaged or delayed, the customer should inform the local travel guide or Ameropa´s representative as soon as possible.
15.4 Travel Documents
You are obliged to notify Ameropa-Reisen in the event of your travel documents (e.g. tickets or vouchers) not being submitted within the period stipulated in subparagraph 2.1 of Ameropa´s present Booking Conditions.

16. Limitation of Liability
16.1 Ameropa´s contractual liability for damages, except damages arising from injury to life, body or health, is limited to three (3) times the amount of the total travel costs, if
a) the damage of the customer is caused by neither by wilful misconduct or gross negligence of Ameropa Reisen or
b) Ameropa´s responsibility for a customer´s damage solely results from the default of a third party service provider.
Any claims, which may arise pursuant to the Montreal Convention or the “Luftverkehrsgesetz” shall not be affected by the aforesaid limitation.
16.2 Ameropa Reisen does not accept any liability for defaults and personal or material damages relating to brokered events arranged for by third party suppliers (e.g. excursions, sporting events, visits to a theatre, exhibitions, carriage to and from the place of departure to your final destination). This particularly applies to all services advertised for or confirmed as brokered services arranged for by service providers so that it appears to be evident that the relevant services do not form part of the travel contract.
Ameropa Reisen accepts liability for
a) services including carriage from your scheduled place of departure to your scheduled destination and carriage and accommodation during your journey,
b) damages caused by Ameropa Reisen not attending its duties to indicate or inform passengers about certain aspects of the journey. The same applies to damages caused by Ameropa Reisen not attending its organizing duties.

b) Ameropa´s responsibility for a customer´s damage solely results from the default of a third party service provider.

17.2 The time limit shall begin on the day following that on which the tour contractually ends. If the last day of the time limit falls on a Saturday, Sunday or public holiday, the deadline will expire on the following business day.
17.3 The timely enforcement can be made against Ameropa Reisen only to the address mentioned below.
17.4 After expiration of the deadline, the customer may only assert claims if he or she was prevented without fault from the observance of the deadline.
17.5 The deadline set out in 17.1 does also apply to the deadline for notification of damaged, delayed or lost baggage relating to flights in accordance with 15.3, as far as warranty rights (§§ 651 c III, 651 d, 651 e III and IV BGB) are concerned. This must be reported within seven (7) days for damaged baggage and within 21 days of delivery for delayed baggage.
17.2 The time limit shall begin on the day following that on which the tour contractually ends. If the last day of the time limit falls on a Saturday, Sunday or public holiday, the deadline will expire on the following business day.

18. Limitation of Actions
18.1 The statutory period of limitation for claims for damages arising from injury to life, body or health, as per §§ 651c-651f BGB, due to Ameropa´s negligent behaviour or negligent or intentional behaviour of one of Ameropa´s statutory representatives or agents, will be two (2) years. The same applies to any other claims for damages due to Ameropa´s gross negligence or gross negligent or intentional behaviour of one of Ameropa´s statutory representatives or agents.
18.2 The statutory period of limitation for all other claims, as per §§ 651c-651f BGB, will be one (1) year.
18.3 The time limit as set out in 18.1 and 18.2 shall begin on the day following that on which the tour contractually ends. If the last day of the time limit falls on a Saturday, Sunday or public holiday, the deadline will expire on the following business day.
18.4 As long as the parties negotiate about claims made, the statute of limitations will be suspended until one of the parties refuses to keep on negotiating.
Claims shall not become time-barred until at least three months after the limitation period has re-commenced.

19. Information Obligations on the Identity of the Operating Carrier
According to EU Regulation on the obligation to inform air passengers of the identity of the airline company operating a flight, at the time reservation is made, Ameropa Reisen is required to inform its customers of the identity of the operating airline company for all transportation services rendered in the framework of the reserved trip. If at the time of the reservation the operating airline company has not yet been determined, Ameropa Reisen is obligated to inform the guest which airline or airlines will most likely operate the flight. As soon as Ameropa Reisen knows which airline will conduct the flight/s it must inform its customers accordingly. If the airline conducting the flight changes to another airline other than the one already mentioned to the customer, Ameropa Reisen must inform its customers of the change. It must take all reasonable measures necessary to ensure that the customer is informed as quickly as possible of the change. 20. Passport, Visa and Health Requirements
20.1 Before the contract is concluded, Ameropa Reisen will inform German nationals of passport, visa and health regulations of the country where the journey is to take place and of any changes that might be made prior to the beginning of the trip. For citizens of other states, the embassy in question can provide information. It is assumed that there are no special circumstances for the guest or any travel companions (e.g. dual citizenship, statelessness). German nationals will find a summary of the requirements to be met at: http://auswaertiges-amt.de.
For Germans (D), Luxemburgians (L), Austrians (A) und Swiss (CH) the following rules apply (Date Juni 2012). (P = valid Personalausweis; R = valid Reisepass/Passport; V = Visa). The figure behind the document indicates the months the document has to be valid after the end of the booked tour.)

² The Reisepass/ passport needs to have at least two empty pages for the entry stamp. The costs for visa mentioned in the price lists are valid for German nationals. In case of cancellation or amendment of the tour, the visa costs will be charged at 100% if visa were ordered through Ameropa Reisen.
20.2 The customer is responsible for obtaining and carrying any necessary travel papers, any necessary immunizations and for adhering to customs and exchange control regulations. He or she will be liable for any penalties or losses that result from failure to conform of these regulations, for example, payment of withdrawal costs. This does not apply if at its own fault Ameropa Reisen has not provided information or has provided incorrect or insufficient information.
Ameropa Reisen will charge customers with withdrawal costs in case he or she does not meet all necessary entry requirements. The same applies if he or she does not hold all necessary visas at the time necessary.
20.3 If the customer has commissioned Ameropa Reisen to obtain any necessary visas, Ameropa Reisen is not liable for timely issuing by consular authorities or availability of these visas, unless at Ameropa´s own fault it has failed to carry out its obligations.
20.4 The customer shall be responsible to ensure that he or she receives the relevant information relating to infection, immunisation protection as well as all other preventive measures on time. The Customer should, when relevant, receive medical advise on thrombosis and other health risks. General information can be obtained in particular from the health authorities, doctors experienced in travel medicine, tropical medical doctors, travel medicine information services as well as the Federal Centre for Health Education.

21. Insurance
Please keep in mind that a travel cancellation insurance is not included in the travel price. The withdrawal from contract might be expensive. Therefore we strongly recommend to take out the special Ameropa Travel Cancellation* insurance policy with the Europäische Reiseversicherung AG.

22. Data Protection
22.1 Ameropa Reisen will save and process personal data only for contractual purposes. Your personal data will not be transmitted to third parties. Ameropa Reisen is entitled to use contractors to process personal data (contractors are committed to act according to § 11 Bundesdatenschutzgesetz).
22.2 As long as the customer does not oppose, Ameropa Reisen will use his or her personal data for design and development of its own products and for advertising and market research purposes.
22.3 The customer is entitled to cancel the aforementioned agreement by informal written notice at any time. Ameropa Reisen will then erase all personal data except the data which is vital for its contractual obligations.
22.4 With reference to the Bundesdatenschutzgesetz, Ameropa Reisen is obliged to protect and save any personal data from abuse.
22.2 As long as the customer does not oppose, Ameropa Reisen will use his or her personal data for design and development of its own products and for advertising and market research purposes.
22.3 The customer is entitled to cancel the aforementioned agreement by informal written notice at any time. Ameropa Reisen will then erase all personal data except the data which is vital for its contractual obligations.
22.4 With reference to the Bundesdatenschutzgesetz, Ameropa Reisen is obliged to protect and save any personal data from abuse.
Force Majeure
In any event of cancellation due to force majeure we would like defer to § 651j BGB (German Civil Code). § 651j BGB reads analogous as follows:
(1) Both the Tour Operator and the passenger are entitled to cancel the contract solely under the provisions of the present § 651j BGB in case of considerable complication, danger or annoyance to the journey.
(2) In the event of the cancellation due to subparagraph 1, the provisions of § 651e subparagraph 3 clause 1 and 2, subparagraph 4 clause 1 BGB will apply. The Parties will share additional costs for the back haul. Any other additional costs will be placed to the debit of the passenger.

(2) In the event of the cancellation due to subparagraph 1, the provisions of § 651e subparagraph 3 clause 1 and 2, subparagraph 4 clause 1 BGB will apply. The Parties will share additional costs for the back haul. Any other additional costs will be placed to the debit of the passenger.
